Landlord Collected Overcharge for Parking Space

Rent-stabilized tenant complained of a rent overcharge. He claimed that landlord illegally raised his $30 parking space charge to $55. The DRA ruled for tenant, and landlord appealed. The DHCR ruled against landlord. Parking is an ancillary service, subject to the ETPA. At the time of lease renewal, landlord was entitled to collect only rent guidelines increases over the initial parking charge.
