Landlord Claims Building Located in ‘Wind Tunnel'

DOS issued a violation notice to landlord for a dirty sidewalk. Landlord claimed he swept in front of the building twice a day. The ALJ ruled against landlord and imposed a $50 fine. Landlord appealed, arguing that the building was located in a ''wind tunnel.'' ECB ruled against landlord. The building was located in a very heavily trafficked area. Landlord is required to sweep as many times a day as needed to keep the front of the building clean.
