Landlord Can't Recover Apartment

Landlord sued to evict rent-stabilized tenant to recover his apartment for owner occupancy. The trial court ruled against landlord. Landlord appealed and lost. Landlord needed to prove his honest intention to occupy tenant's apartment. The trial court considered the fact that landlord started a prior owner occupancy case against another tenant in the building. The trial court's decision was based on a fair evaluation of the evidence.
