Landlord Can't Collect Two Month's Rent

Tenant complained of a rent overcharge. Among other things, tenant claimed that landlord collected two month's rent as a security deposit when tenant moved into the apartment in 1997. The DRA ruled against tenant, finding no rent overcharge. The DRA didn't address tenant's security deposit claim in its order. Tenant appealed and won. Under Rent Stabilization Code Section 2525.4, landlord can't collect more than one month's rent as a security deposit.
