Landlord Can Send Renewal Lease by Hand Delivery

Rent-stabilized tenant complained that landlord had not properly renewed his lease. Landlord responded that he had hand-delivered a copy of the renewal lease to tenant. The DRA ruled for landlord and dismissed the complaint after tenant didn't respond to the DRA's request for confirmation of landlord's claim. Tenant appealed and lost. Tenant claimed that he was away when the DRA requested additional information. He also claimed that landlord's hand delivery of the renewal lease was improper.

But Rent Stabilization Code Section 2523.5 permits delivery of a renewal lease by "mail or personal delivery." And tenant signed the renewal lease in question. Tenant's complaint was fully resolved and properly dismissed.
