Landlord Can Require Deposit for Installation of Satellite Dish Antenna on Roof

Tenant asked the DHCR if landlord could charge him a $200 security deposit for placing a satellite dish antenna on the building's roof. In an opinion letter, the DHCR said yes. If tenant put the satellite dish in part of his leased space, such as a balcony or terrace, landlord couldn't charge the security deposit. But because tenant wanted to install the dish on the roof, landlord was entitled to a security deposit against roof damage. This deposit isn't ''rent'' under the Rent Stabilization Code, so the DHCR would have no authority to rule on any dispute over this money.
