Landlord Can Evict Unauthorized Subtenant
LVT Number: 12407
Landlord sued to evict tenant for illegal subletting. The court ruled against landlord, finding that tenant had lawfully assigned the apartment to tenant. Landlord appealed and won. Landlord proved in the lower court that tenant had sublet the apartment without getting landlord's permission. Tenant had moved out, and subtenant had no independent rights to the apartment or to argue against the eviction.
