Landlord Can Collect Low-Rent Supplement Despite Temporary MCI Increase

LVT Number: 11083

Tenant complained of a rent overcharge. The DRA ruled against tenant, and tenant appealed, claiming that the DRA made calculation errors. The DHCR ruled against tenant. Tenant mistakenly added the amount of a temporary MCI increase to the legal rent. Although this amount was collectible, it didn't become a permanent part of the rent and didn't prevent landlord from receiving a $15 supplement for rents below $300 under Rent Guidelines Board Order No. 17.
