Tenant complained of a rent overcharge. He occupied two apartments in the Chelsea Hotel. The DRA ruled against tenant. The two apartments were temporarily exempt on the base date, so his rent wasn't subject to challenge. Tenant appealed. Landlord had signed a settlement agreement in court agreeing to refund an overcharge to tenant and agreeing not to charge him any rent for as long as he lived in the building. The DHCR ruled for tenant. Landlord was bound by the settlement agreement.
