Landlord applied for MCI rent increases based on a number of installations, including kitchen modernization. The DRA disallowed costs for the kitchen modernization, and landlord appealed. Landlord claimed that new kitchens were installed in each apartment. The DHCR ruled that further investigation was needed. The DRA inspected only two out of 78 apartments. In one apartment the refrigerator hadn't been replaced; and in another, the area around the newly installed kitchen cabinets and sink hadn't been completely restored.

Many other tenants stated that their kitchens had been partially renovated, but they complained about the quality of the work. The DHCR noted that kitchen modernization consists of the installation in every apartment of new sinks, counter-tops, and cabinets, and that the cost of new appliances may be allowable as related MCI costs. The case was sent back to the DRA for further inspections and processing.
