Installation of BPD, Including Initial Testing and Engineer Inspection, Qualifies as MCI

The DRA granted in part landlord’s application for MCI rent hikes based on backflow engineering and installation of a backflow prevention device. The DRA disallowed some fees associated with permits and testing the device. Landlord appealed and won, in part. When required by law, the installation of backflow prevention devices constitutes an MCI for which a rent increase may be granted. Since the device needed to be tested and certified by a NYC Licensed Master Plumber and inspected and certified by an engineer or architect, the initial testing was necessary for proper installation and that $700 cost qualified for an MCI increase. The MCI rent hike was therefore increased by $0.06 per room per month.
