Increase Previously Granted for Roof Replacement

Landlord applied for MCI rent hikes based on the installation of a new roof. The DRA ruled against landlord. Landlord appealed and lost. Landlord did the roof installation in 2003. But landlord did a prior roof installation in 1993 and got an MCI rent hike for that work. The useful life of a roof is 20 years under DHCR regulations, and landlord didn't get a required waiver of the useful life provisions before filing its second MCI application.
