Landlord applied for MCI rent hikes based on the installation of new windows. The DRA ruled against landlord because of a prior MCI increase for windows, granted in 1991, based on a window installation that was completed in 1983. Landlord appealed and won. Landlord had previously installed vinyl windows. New windows were installed 17 years later. The useful life for vinyl windows, according to the DHCR, is 15 years. So the new windows qualified as an MCI.
