Inadequate Freezer Temperature

Tenant complained of a reduction in services. The DRA ruled for tenant based on inadequate freezer temperature and reduced his rent. Landlord appealed, claiming that the DHCR's finding wasn't based on tenant's complaint. The DHCR ruled against landlord. Tenant had complained that the refrigerator kept defrosting and food spoiled. An inspection showed that the freezer temperature was 15 degrees Fahrenheit. Industry standards for freezer temperatures required a temperature of five degrees Fahrenheit or less. So the DRA's finding of inadequate freezer temperature was proper.
