Improvements Made by Prior Landlord

Tenant complained of a rent overcharge. The DRA ruled for tenant. Tenant appealed, arguing that the overcharge award should be larger. Tenant claimed that the DRA shouldn't have allowed any rent increase for the installation of new carpeting because it was installed by prior landlord. The DHCR ruled against tenant. It didn't matter who installed the carpeting. Landlord submitted sufficient proof of the cost and that the work was done. The DRA properly granted a rent increase for this 1/40th improvement.
