Improper Delivery of Violation Notice

DOB issued a violation notice to landlord. Landlord claimed improper delivery of the notice. The ALJ ruled against landlord, and landlord appealed, pointing out that the violation notice was sent to a building employee by the ''deliver and mail'' method. But this method is permitted only for one-, two-, or three-family residential buildings. Since landlord's building was a multiple dwelling with four or more units, the delivery was improper under city regulations. ECB ruled for landlord and revoked the fine.
