HPD Improperly Terminated Tenant's Rent Subsidy

HPD terminated tenant's Section 8 rent subsidy after her children no longer lived in the apartment with her. Tenant filed an Article 78 appeal of HPD's decision. The court ruled for tenant. HPD appealed and lost. HPD's decision was arbitrary and unreasonable under the circumstances of this case, and tenant's benefits were improperly terminated.
