Homeless Shelter Resident Can Sue Prospective Landlord for Discrimination

LVT Number: #33204

A legal representative sued landlord on behalf of a homeless shelter resident based on lawful source of income discrimination. The shelter resident had received a housing voucher from the city. Landlords asked the court to dismiss the case. The court ruled against landlords, finding that the housing discrimination claim was adequately pleaded. The court found that the plaintiffs didn't need to allege at this stage that the landlords authorized their agent to specifically discriminate in order to be held liable. And plaintiffs had standing to bring the claim.
