High-Rent/High-Income Petition Sent to Wrong Tenant

Landlord applied for high-rent/high-income deregulation of tenant's apartment in 2007. Landlord named Andree Corroon as tenant. The DRA ruled for landlord based on tenant's failure to answer the DRA's notice of landlord's petition. Another tenant, Christopher Foss, appealed. He said that Corroon no longer lived in the apartment and that Foss was the current tenant. Corroon's last lease expired on May 31, 2007, and Foss's first lease commenced on Dec. 31, 2007. So when the DRA sent its notices, in January 2008 and May 2008, the named legal tenant of the apartment was Foss, not Carroon. The DHCR ruled for tenant and reopened the case. The DRA must send new notices of landlord's petition to the current tenant.
