Heat Restored Before Complaint Filed

Tenants complained of no heat between Oct. 1 and Nov. 8, 1987. Landlord answered that a new boiler/burner was being installed during that time, and was completely installed by Nov. 9. An inspection in January 1988 showed adequate heat, but inadequate hot water, in several apartments. For this reason, the DRA reduced tenants' rents. Landlord appealed, and the DHCR ruled for landlord. Heat had been restored on Nov. 9, before tenants' complaint was even filed. Tenants had also told a DHCR inspector that this service was restored. And tenants didn't complain of insufficient hot water.
