Landlord applied for MCI rent hikes based on the installation of a new boiler/burner. The DRA ruled for landlord, and tenants appealed. They claimed that landlord wasn't properly maintaining heat and hot water in the building. The DHCR ruled for tenants. There were presently 652 HPD violations on the building, 115 of which were hazardous violations. Eighteen of the hazardous violations involved the heating system and were reported after the new boiler/burner was installed. One ''C'' violation was pending when the DRA ruled on the MCI rent hikes.

There were presently 652 HPD violations on the building, 115 of which were hazardous violations. Eighteen of the hazardous violations involved the heating system and were reported after the new boiler/burner was installed. One ''C'' violation was pending when the DRA ruled on the MCI rent hikes. That violation was for nuisance because the hot water was over 157 degrees. This was too hot and could cause scalding burns.
