Hallway Painting Doesn't Qualify

Landlord applied for MCI rent hikes for pointing/waterproofing and painting building hallways. The DRA ruled for landlord in part but disallowed any increase for the hallway painting. Landlord appealed and lost. Hallway painting done to fix leaks or done in connection with pointing/waterproofing doesn't qualify as a major capital improvement. It is considered repairs and maintenance, which is cosmetic and nonstructural.
