Gut Rehab Done Without Permit

DOB issued a violation notice to landlord for performing work without a permit. DOB's inspector observed interior demolition work, described as a "full gut rehab." Landlord denied that she was doing any structural work that required a permit and claimed that damage to the building was caused by a fire and was being repaired at the time of the inspection. The ALJ ruled against landlord and fined her $1,600. Landlord appealed and lost. Building Code Section 28-105.1 makes it unlawful to alter, repair, or demolish a building without a DOB permit. While there are exceptions for minor alterations and ordinary repairs, this was limited to work that didn't affect health or the fire or structural safety of the building. DOB's photographs showed substantial removal of interior walls, ceilings, and flooring.
