Granddaughter Gets Tenant's Rent-Stabilized Apartment

Landlord sued to evict rent-stabilized tenant's granddaughter after tenant moved out of the apartment to enter a nursing home in 2010. The granddaughter claimed succession rights. The court ruled for the granddaughter after trial. The granddaughter testified that she had lived her whole life in the apartment. Federal and state tax returns for 2009 through 2011 supported her claim, along with other documents. The granddaughter showed that both she and tenant lived in the apartment as their primary residence for at least two years before tenant permanently vacated to move to the nursing home.
