Granddaughter Gets Deceased Tenant's Apartment

Landlord sued to evict Mitchell-Lama tenant's granddaughter after tenant died. The granddaughter claimed pass-on rights to the apartment. Landlord argued that she didn't meet the requirements to stay as a remaining family member. The court ruled against landlord. The granddaughter had been listed in tenant's annual income and family composition form for the apartment. She qualified for pass-on rights under applicable New York City pass-on regulations.
