Gas Repiping Qualifies as MCI

The DRA granted landlord's MCI rent increase application based on gas repiping. Tenants appealed and lost. Tenants claimed that they had no gas service for several months and that the work done was a repair, not a major capital improvement. The DHCR's long-standing position is that gas repiping done on a building-wide basis qualifies as an MCI required for the operation, preservation, and maintenance of the structure.
