Garbage Receptacles Blocked Sidewalk

DOS issued a violation notice to landlord for not storing garbage receptacles. Landlord claimed that the building was located on a corner and there was no place to store the containers. So landlord stored them on the sidewalk at the building line. The ALJ ruled against landlord and fined it $50. Landlord appealed and lost. City law permits the storage of garbage receptacles in front of buildings behind the stoop line when there is no place to store them inside or behind a building. But the receptacles must be kept closed.

But the receptacles must be kept closed. Landlord's receptacles were open, overflowing, and blocking the sidewalk. This created a nuisance and DOS properly issued a violation.
