Fuel Cost Adjustment Correctly Calculated

Landlord filed a 2006 fuel cost adjustment (FCA) report, which tenant challenged. In response to tenant's challenge, the DRA calculated the FCA at $6.16 per room per month. Landlord appealed, claiming that the DRA previously denied tenant's challenge to landlord's 2001 FCA report, and that landlord had correctly calculated the FCA for 2006 at a different amount. The DHCR ruled against landlord. Landlord incorrectly used the cumulative 2001 FCA to calculate the 2006 FCA. Landlord's calculations were inconsistent with the calculations set forth in the DHCR's fuel cost history.
