Four-Year Rule Bars Tenant's Fair Market Rent Appeal

Tenant filed a fair market rent appeal on Aug. 11, 1998, challenging the initial legal regulated rent of $1,400, which was charged starting on Aug. 1, 1994. The DRO ruled against tenant and dismissed the complaint. Tenant's fair market rent appeal was filed more than four years after tenant's lease began. So the complaint was barred by the four-year rule.
