Foundation Repairs Qualify

Landlord applied for MCI rent hikes based on a number of improvements, including foundation repairs. The DRA ruled for landlord. Tenants appealed, claiming that the work wasn't an MCI and was the subject of a prior rent reduction order. The DHCR ruled against tenants. Rents had been restored before the MCI rent hike was granted. And foundation repairs qualified as an MCI.
