Former Tenants Claim Landlord Misrepresented They Could Have Dog

Warren County landlord sued former tenant for breach of the lease after tenants moved out of the apartment early, without notice. Tenants claimed fraud in the inducement. They said they told landlord they were getting a puppy and that landlord assured them they could get written consent even though the property prohibited keeping dogs. After they moved in and got the dog, they were told that all dogs were prohibited.

The court ruled against tenants because they failed to identify the time and place of landlord’s alleged misrepresentation or the employee who made the misrepresentation that they could have a puppy in the apartment.
