First Tenant After Rent Control Was Rent Stabilized

Landlord sued to evict unregulated tenant for nonpayment of rent. Tenant claimed that he was rent stabilized. The court ruled for tenant. The prior tenant was rent controlled. Tenant moved into the apartment on June 15, 2015, under a lease at a monthly rent of $2,500 per month. Since this rent was below the $2,700 deregulation threshold in effect at that time, tenant was subject to rent stabilization and had been improperly deregulated.
