Fire Alarm System Didn't Qualify as MCI

The DRA denied landlord’s application for MCI rent hikes based on the installation of an automatic fire alarm system. Landlord appealed and lost. The fire alarm system wasn’t required for the operation, preservation, and maintenance of the building structure. Smoke detectors associated with the fire alarm system were placed only within the basement, elevator lobbies, and elevator shafts. Landlord’s claim that the fire alarm system increased the security of the building wasn’t a grounds to qualify the fire alarm system as an MCI.
