Fines Reduced Where Landlord Submitted BPD Test Reports Before Hearing

The DEP issued violation notices to landlord for failing to submit an annual test report for three backflow prevention devices. At a hearing landlord presented test reports that showed compliance before the hearing date. The ALJ imposed a mitigated penalty for one of the charges and standard penalties for the other charges. Landlord was fined a total of $1,050. Landlord appealed and won. Landlord was entitled to mitigated penalties for all three violations. So the total fine was reduced to $150.
