Family Members Didn't Prove They Lived with Tenant for at Least One Year

Rent-stabilized tenant's family members complained that landlord refused to give them a renewal lease. They claimed that they had pass-on rights to tenant's apartment. The DRA ruled against family members. They appealed, claiming that the family rented four apartments in landlord's building, and had lived in the building since 1971. They said that since they each had lived elsewhere in the building before moving in with tenant to care for her, correspondence was addressed to them at the building, but not at tenant's apartment. The DHCR ruled against family members.

Tenant's family members didn't prove that they lived with tenant in tenant's apartment for at least one year before tenant died. They had no pass-on rights to tenant's apartment.
