Fair Market Rent Is over $2,000 per Month

Tenant filed a fair market rent appeal. The DRA ruled for tenant and reduced the rent from $2,000 to $1,970. Landlord appealed. The DRA hadn't included an MCI increase when calculating the fair market rent. The fair market rent for the apartment was actually over $2,000. The DHCR ruled for landlord. Landlord's calculations were correct. And since the legal rent was at least $2,000, the apartment was deregulated and the rent wasn't subject to a fair market rent appeal.
