Facade Inspection Not Required for Six Story Building

DOB issued a violation notice to landlord for not submitting a report of periodic inspection of the building's exterior walls. Landlord claimed it didn't have to get the building facade inspected because the building wasn't over six stories. The ALJ ruled for landlord and dismissed the violation because the building was only six stories in height. DOB appealed, claiming that the building was more than six stories. ECB ruled against DOB. The C of O stated that the building was six stories. DOB didn't show that the C of O was incorrect.
