Exterior Work Includes Parapet Replacement

The DRA granted landlord's application for MCI rent hikes based on exterior restoration. Tenants appealed. Among other things, they claimed that the work was defective and incomplete and that there was water infiltration in some apartments from the exterior walls. The DHCR ruled against tenants. The DRA had fully considered their evidence, including an engineer's report. DHCR inspection found that all sides of the building had been pointed and that the MCI was done in a workmanlike manner.

It was proper to include the cost of parapet replacement as part of the MCI since this work was related to the exterior restoration. Tenants' claim that landlord's self-certification of the work with DOB was invalid was outside the scope of the DHCR's review. There was no proof of water damage in the six apartments cited by tenants.
