Engineer's Affidavit Proved Correction of Violations

Landlord filed a violation certification for the 1992–93 MBR cycle, stating that all rent-impairing violations and 80 percent of all other violations had been corrected. The DRA granted landlord's application for 1992–93 MBR rent increases. Tenant appealed, claiming landlord hadn't corrected all required violations. The DHCR ruled against tenant. Landlord had submitted an engineer's affidavit with is violation certification. This was sufficient to prove that landlord had corrected the necessary percentage of violations.
