Empty Boxes Left by Tenant

The DOS issued a violation notice to landlord for loose rubbish. Two large boxes, neither tied nor bound, were left on the sidewalk in front of landlord's building. Delivery men had brought a new refrigerator to tenant and left the boxes containing the appliance on the sidewalk. The violation notice was issued within two hours. The ALJ found landlord responsible and imposed a $25 fine. Landlord appealed, and the ECB affirmed the ALJ's ruling. The delivery men were tenant's agents, and landlord is responsible for tenant's actions.
