Elimination of Live-in Super Isn't a Reduction of Services

Rent-stabilized tenant complained of a reduction in building-wide services after landlord eliminated live-in superintendent service. The DRA ruled against tenant, finding no reduction in services. Tenant appealed and lost. It is long-standing DHCR policy that, by itself, discontinuing live-in super service doesn't constitute a reduction in services unless there is also a reduction in provided janitorial service at the building. The DHCR found no reduction in janitorial services at the building, and there were no HPD or DOB violations. Initial registration records also showed that landlord registered maintenance services but not a live-in super.
