Elevator Shut Down on Date of Inspection

Landlord applied for MCI rent hikes based on the installation of new elevator controllers and a push-button system. Tenants claimed that the new elevator service was inadequate. An inspection on two separate dates several months apart showed that one of the elevators was inoperative. The DRA therefore denied landlord's MCI application, and landlord appealed. Landlord claimed that on the dates of the inspections, that elevator was shut down for ordinary repairs. Landlord submitted a letter from its contractor stating that on four dates the elevator had been shut down for repair work.

The DHCR found that landlord was entitled to a rent increase for the new controller/selector. The repair work that took place on the inspection dates was necessary to ensure the elevator functioned in a reliable manner. A more recent inspection had also showed that the elevator now functioned.
