DRA's Findings Went Beyond Scope of Complaint

Tenant complained of a reduction in services, claiming black bathroom tiles didn't match. The DRA ruled for tenant, based on an inspector's finding that white tiles didn't match, and reduced tenant's rent. Landlord appealed. The DHCR ruled for landlord and revoked the rent reduction. Tenant had complained about black tiles that didn't match. So the DRA's finding based on the white tiles went beyond the scope of tenant's complaint.
