DRA Improperly Calculated Overcharge Amount

Tenant complained of a rent overcharge. The DRA ruled for tenant and landlord appealed. The DRA had calculated the overcharge amount due tenant for the period between August 1982 and July 1983. But tenant had moved out on April 30, 1983, and landlord had already refunded the overcharge found through that date. The DHCR ruled for landlord. Since tenant moved out on April 30, 1983, the overcharge period ended on that date.
