DOS Named Wrong Owner in Violation Notice

DOS issued a violation notice to landlord for improper curbside placement of containers for recyclables. Landlord objected to the violation. She said that she owned and lived at 1033 221st Street. The violation was for 1035 221st Street. The ALJ ruled against landlord and fined her $25. Landlord appealed, again asserting that she had no relationship to 1035 221st Street. ECB ruled for landlord and revoked the fine. The record showed that landlord didn't own and wasn't responsible for placing recyclables out in front of 1035 221st Street.
