Door Plates and Floor Signs Don't Qualify as MCIs

Landlord applied for MCI rent hikes based on new intercoms, apartment and common area doors, and hallway renovation. The DRA ruled for landlord in part, but disallowed certain claimed costs as ineligible. The DRA also disallowed a portion of the MCI costs allocable to commercial space in the building. Landlord appealed and won, in part. The DRA correctly disallowed the cost of door plates and floor signs from any increase for hallway work, as well as the cost of a lobby console table and mirror. These items weren't necessary for and directly related to any qualifying MCI.

The DHCR agreed with landlord that no portion of the MCI cost should be allocated to the building's commercial space since the work benefitted only the residential portion of the building.
