DOB Filing Fees Not Included in MCI Application Costs

Landlord applied for MCI rent hikes based on the installation of a new garage roof. The DRA ruled for landlord in part but disallowed any increase for an inspector's fee for concrete placement cancellation, landscape architect services, painting, architect fees, and asbestos and filing fees. Landlord appealed and won, in part. Professional fees for construction plans to replace the surface parking lot and parking garage roof were required by DOB and complex enough to require an architect's services. The DRA also had disallowed over $12,000 in DOB filing fees from landlord's MCI costs. But landlord submitted proof that the DOB filing fees weren't part of MCI costs claimed in its application.
