Direction to Restore Services No Bar to MCI Increase

Landlord applied for MCI rent hikes based on the installation of a new intercom system. The DRA ruled against landlord because there was a building-wide service reduction order in effect. Landlord appealed and won. The prior order merely directed a restoration of services; it didn't provide for any rent reduction. So under DHCR Policy Statement 90-8, landlord wasn't barred from collecting an MCI rent hike for the intercom.
