DHCR Request for More Proof of Improvements Not Warranted

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord claimed it was entitled to collect a 1/40th rent increase for improvements to the apartment. The DHCR ruled for landlord in part. Landlord had submitted two signed contracts supporting a total claimed cost of $7,400 for remodeling the kitchen and bathroom. This satisfied the DHCR requirement for one form of documentation of improvement. Under DHCR Policy Statement 90-10, the DHCR may require additional proof if there's doubt about landlord's claim.
