DHCR Rent Reduction Order Upheld

Westchester rent-stabilized tenant complained of a reduction in required services. The DHCR ruled for tenant and reduced his rent. Landlord appealed twice and lost. Landlord claimed that the DHCR’s decision was unreasonable. But the DHCR found that there had been a decrease in services at tenant’s apartment, warranting a rent reduction. The agency’s decision was based on a physical inspection of tenant’s apartment and had a rational basis.
